Minimising Bankruptcy Disruption

I was approached by a doctor with a private practise and significant tax liabilities.  I advised him that it was in his interest to go bankrupt rather than propose an Individual Voluntary Arrangement.  I then liaised closely with his accountant during the setting up of a new legal entity to become the doctor’s employer and to trade the business.  In addition we designed various procedures and safeguards to ensure that tax liabilities could not accrue again.  I was instructed by the doctor’s wife to render appropriate assistance and since his bankruptcy I have liaised with the Trustee in Bankruptcy and advised the doctor’s wife on the effect of his bankruptcy on her and their jointly owned assets.  As a result the doctor has continued to earn a good living, the Trustee has been able to realise the assets very smoothly which will result in lower costs and therefore a higher dividend to creditors, and the emotional distress of the doctor and his wife has been minimised.
