Successful Negotiation with Landlord

A successful company opened a second site which traded very unsuccessfully. The losses from the second site would result in the failure of the company so the Directors tried to close the second site. However the landlord was extremely unreasonable. He refused to accept voluntary surrender for anything less that payment of the remaining four years’ rent, plus notional dilapidations. I was instructed to prepare a short report to the landlord advising him of the company’s situation and that his continued recalcitrance would result in the company’s Administration within 9 months. In an Administration his claim would be restricted and he would receive a minimal dividend, if any. The Directors and I met with and corresponded with the landlord and were able to negotiate a settlement of one years’ rent. This enabled the company to close the loss-making site and continue trading profitably.
